PERB Issues Directed Order for Decertification Election

Teamsters Local 228 Will Not Be Provided Peace Officer Home Addresses

On August 31, 2005 a pre-election meeting was held at the Public Employment Relations Board in Sacramento to establish the timing and ground rules of the upcoming decertification election.

In attendance on behalf of CAUSE were President Alan Barcelona, Controller Ricardo Sanchez, Chief Legal Counsel Kasey Christopher Clark and Attorney Gary Messing. Local 228 was represented by an attorney and three of its organizers. Conspicuously absent was Local 228 Secretary/Treasurer Victor Shada. Also in attendance were representatives of the Department of Personnel Administration, the State Controller's Office, the Department of Justice and the Departement of Parks and Recreation. The pre-election meeting was presided over by PERB Board Agent Roger Smith.

During the meeting the parties agreed on voter eligibility, the timeline for the conduct of the election and restrictions on peace officer home address information:

Voter Eligibility - Those employees in Unit 7 positions as of 9/2/05 who have worked at least 10% during the previous 12 months and have a reasonable expectation of future employment and employees on approved absences, i.e. military leave.

Election Timeline:

9/2/05 – Last day to Notify PERB of any Changes/Deletions/Additions to Unit 7 Classification List

9/16/05 – Last day for State Controller’s Office to Provide List of Eligible Unit 7 Members to PERB (List will identify employees by name, voter i.d., classification code and work site by appointing authority, i.e. all DOJ employees will have DOJ Headquarters listed as their work address)

9/23/05 – Last day for CAUSE and Local 228 to object to eligible list

10/7/05 – PERB mails election notice notfying elible voters they will soon be receiving a ballot

10/14/05 – PERB mails ballots

10/28/05 - Last day to request duplicate ballots (Members who do not receive ballots should call 916-322-3198 to request a duplicate ballot. If an employee submits more than one ballot only the last ballot received will be counted).

11/18/05 – Last day for ballots to be received by PERB (5:00 p.m.)

11/21/05 – PERB will count ballots at 10:00 a.m. and notify the parties of the results

Access to Work Sites --- Local 228 will continue to have the same access rights they have had during the interest card campaign, i.e. areas accessible to the public to employees during non-work time.

Peace Officer Home Address Info – Local 228 will not be provided home addresses of Unit 7 peace officers and instead will be provided a last known work address as an alternative to a home address. Agencies will be required to process work site mailings via first class mail in the same manner that all other first class mail is processed.

NOTE: If you are a Unit 7 peace officer and receive literature at your home and you did not provide your address to Local 228, it can be reasonably assumed your home address information was stolen by Local 228. Members are encouraged to report such violations to their agency, to CAUSE and to PERB at 916-322-3198 as the mailing may be evidence of a crime and may also constitute an election violation.
